Privacy Policy for User Surveys, User Interviews and Product Tests

Data protection is a matter of trust and your trust is very important to us. We respect your privacy and personal sphere. The protection and legally compliant collection, processing and use of your personal data is therefore an important concern for us.
To ensure that you feel safe during our user surveys, user interviews as well as product tests, we strictly observe legal provisions when processing your personal data and would like to inform you in detail about the processing of your personal data in the following.

2. Purpose of the Processing of Personal Data
In order to continuously improve our products and services in the interest of our users, we conduct user surveys, user interviews and product tests in which users can participate voluntarily. As part of the user surveys and user interviews, we ask you questions about your sporting activities and your own sporting behavior, and in particular about the products or services used by EGYM. Within the scope of product tests, we test our existing EGYM products as well as prototypes.
With your consent, we will add you to our email list for surveys, interviews and product tests and subsequently send you requests for a survey, interview or product test that are suitable for you.
2.a. Registration for the Distribution List for User Surveys, User Interviews and Product Tests
As part of your registration for your inclusion in the survey email list in our online form provided for this purpose, a pre-survey must be completed so that we only send you the surveys and interviews that are suitable for you or select the product tests that are suitable for you. In doing so, we process the following data from you: Email address, first name, gym affiliation (optional), age, gender, and workout preferences or habits.
If you are included in the survey email list after your registration, we will send you, in accordance with the information you provided in the registration (e.g. age group, gender, training experience), notifications by email approximately every two months about the possibility of participating in various EGYM surveys or interviews, in which you can participate voluntarily.
2.b. Participation in User Surveys
As part of your participation in a user survey, we process the following data from you: Email address, name, training preferences or habits, age, gender and optionally the gym. We need this data in order to be able to evaluate the respective survey and, if applicable, in order to be able to send you - depending on whether this is the case for the respective survey offered - the promised remuneration in the form of an online voucher or, in the case of surveys in which a prize is raffled among all participants, the prize in the form of an online voucher (only if you are one of the winners from the raffle).
2.c. Participation in User Interviews
In the course of your participation in a user interview, we process video recordings of you, recordings of your voice, your email address, your name, training preferences or training habits, your age, your gender and your affiliation with a particular gym. We need this data to be able to conduct and evaluate the respective interview and to be able to send you the promised compensation in the form of an online voucher.
2.d. Participation in Product Tests
In the context of your participation in product tests, we process personal data insofar as this is necessary for the use of the respective product, see our general data protection declaration. We process video recordings of you, recordings of your voice, your email address, your name, as well as training preferences or training habits , your age, your gender and your affiliation with a particular gym. We need this data to be able to carry out and evaluate the respective product test and to be able to send you the promised compensation in the form of an online voucher.
3. Legal Basis
The processing of the personal data mentioned in each case under point 2 is necessary for the fulfillment of a semi-contractual relationship with you or for the implementation of corresponding pre-contractual measures. The legal basis for registration for participation in a survey, interview or product test, notification of suitable surveys, interviews or product tests, as well as participation in a survey, interview or product test is therefore fundamentally Art. 6 para. 1 sentence 1 lit. b DSGVO.
If the respective survey or interview includes questions whose answers contain or could contain health-related information about you (e.g. about your physical fitness), we will only process this data with your consent. The legal basis for this is then Art. 6 para. 1 p. 1 lit. a DSGVO in conjunction with. Art. 9 para. 2 lit. a DSGVO (processing based on the consent of the data subject). You can revoke this consent at any time with effect for the future, see section 7.
4. Storage Period
The data processed in connection with participation in surveys, interviews or product tests will remain stored by us for as long as necessary to fulfill the above purposes, i.e. at least as long as you are registered with us for participation in surveys. The information provided by you in the surveys, interviews and product tests will be anonymized by us after a period of 3 years and will only be evaluated/stored anonymously thereafter. The contact data will be deleted by us as soon as they are no longer required to achieve the purpose of their processing or for documentation purposes, or you click on the "Unsubscribe Newsletter" button in the distribution list.
5. Data Transfer
In the case of some service providers and third-party services that we use, it cannot be ruled out that personal data will be transferred outside the EU/EEA to third countries (esp. to the USA). In these third countries, there is usually no comparable level of protection for data security as in the EU/EEA. To ensure an adequate level of data protection, we conclude so-called EU standard clauses with these service providers, according to which the respective service provider undertakes to comply with standards set by the EU Commission in order to protect your personal data. In addition, we also select service providers based on whether they provide additional guarantees, such as acquired protection certificates and/or proof of additional and appropriate technical and organizational measures to protect your personal data (e.g., an encryption of data).
6. Non-Existence of Automated Decision-Making
Please be advised that you will not be subject to any decision based solely on automated processing - including profiling - which produces legal effects concerning you or similarly significantly affects you.
7. Rights of the Data Subject
You have the following rights vis-à-vis us with regard to the personal data concerning you:
Right to information (Art. 15 DSGVO),
Right to rectification (Art. 16 DSGVO),
Right to erasure (Art. 17 DSGVO; "right to be forgotten"),
Right to restriction of processing (Art. 18 DSGVO),
Right to object to processing (Art. 21 GDPR),
Right to data portability (Art. 20 DSGVO).
You also have the right to lodge a complaint about the processing of your personal data by us with a data protection supervisory authority in the member state of your place of residence, your place of work or the place of the alleged infringement if you believe that the processing of personal data concerning you is carried out unlawfully.
If you have given us consent to process your data, you may revoke this consent at any time with effect for the future. The lawfulness of the processing of your data until the revocation remains unaffected.
